Owner and operator of the website www.gespa.ch is Gespa (Swiss Gambling Supervisory Authority), Erlachstrasse 12, 3012 Bern, Switzerland.
 

The content, design and structure of www.gespa.ch are protected by copyright. Downloading or copying of texts, illustrations, photos or any other data does not entail any transfer of rights on the content. Any reproduction of information or data, in particular the use of texts or text parts and images, requires the prior consent of Gespa.

Gespa regularly checks and updates the information on its website. Despite all care taken, no warranty can be given as to the accuracy, reliability, up-to-dateness or completeness of this information. The same applies for all links to third party websites, which are neither operated nor monitored by Gespa. Access and use of such websites is entirely at the user’s own risk.
 

Gespa does not guarantee the operation of the www.gespa.ch website and expressly reserves the right to modify, delete or temporarily or permanently cease publication of all or part of its contents without prior notice.
 

Liability claims against Gespa for damages of material or immaterial nature arising from access to or use or non-use of published information, misuse of the connection or technical faults are excluded to the extent permitted by law.

The processing of personal data on www.gespa.ch is limited to the data required to provide a functioning website and user-friendly content and services or to the data that you actively provide to us. The personal data we collect will only be stored as long as necessary to fulfil the purpose in question. Legal requirements or further obligations may lead to longer retention. The collected data is carefully managed and protected against misuse.
 

Cookies: So-called session cookies (small text files that are stored on the user's device when visiting the website) are used on www.gespa.ch. The purpose of the cookies is to analyse use for statistical evaluation as well as for continuous improvement of the website. If you only accept the necessary basic functions in the cookie banner, the Matomo tracking system (see below) will not be activated. You can also completely prevent the storage of cookies in your browser by restricting or deactivating the storage and reading of cookies. In this case, not all functions of the website will be available to you.
 

Our website is networked with third-party functions and systems. In the following, we describe those services that process personal data collected on our behalf on the website and explain the data processing. Google ReCaptcha and Google Fonts (Merriweather, Open Sans) are used as web services. Our web host (Cmsbox) also collects data, including via the tracking system Matomo.
 

Google ReCaptcha: The website www.gespa.ch contains contact forms. As the user's data is collected for the purpose of processing enquiries, this is done on the basis of legitimate interests.
 

The forms are protected from unauthorised sending by robots by Google reCaptcha v3. It is technically unavoidable that a large amount of personal data about your usage behaviour is transferred to Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (Google) for this purpose in order to identify you as a human being. Google is committed to ensuring adequate data protection. Therefore, a corresponding notice ("protected by reCaptcha") with a link to the data protection declaration of the operator Google is placed on each form. For further information on the use of your data, please refer to the Google data protection portal.
 

Google Fonts: To display fonts on our website, we use Google Fonts, among others. This is a service from Google, which is, however, hosted on Cmsbox's own infrastructure.

Cmsbox (web hosting of www.gespa.ch): The server infrastructure of Cmsbox GmbH collects a series of general access data each time our website is called up, which are stored in so-called log files. This data is required by Cmsbox to check and ensure the functionality and security of the Cmsbox system.
 

The name of the website accessed, URL, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page) and the user's IP address are recorded. This data is required to check and ensure the functionality and security of our infrastructure.
 

Cmsbox uses the tracking system Matomo (formerly PiWiK), which is used to evaluate visitor numbers and is hosted on Cmsbox's own infrastructure. This data collection helps Cmsbox to operate and improve its services. The collection of data is anonymised, which means that it is no longer possible to draw conclusions about a visitor. The underlying records are automatically deleted after 180 days.
 

Your rights: You have the right to request information about the processing of your personal data at any time. To do so, please contact the address listed under "Contact". Further rights such as the right to data deletion, data correction, restriction of data processing and the right to data transfer exist within the legally prescribed framework.
 

The collection of data for the provision of the website and the storage of data in log files is necessary for the operation of the website. Therefore, there is no right of objection in this regard.
 

Art. 45(2) of the Gambling Concordat (GSK) requires Gespa to appoint an independent data protection supervisory authority. Since 1 January 2021, this has been the data protection office of the Canton of Bern (Datenschutzaufsichtsstelle des Kantons Bern). The office provides legal advice to data subjects and – where possible and appropriate – mediates between them and Gespa.
